On June 23,
2017, WIPO announced a review of the Nice Classification. The changes are said
to have been adopted by the Committee of Experts of the Nice Union at its 27th
Session held in Geneva from May 1 to 5, 2017.
Since its
inception in 1957 following the Nice Agreements, the Nice Classification has
continuously been reviewed by the Committee of Experts. Currently, the Nice
11-2017 is in use.
The
Classification, which is used by all countries parties to the Madrid System as
well as some other countries like Nigeria, who are not parties to the System,
contains 45 classes under which marks are registered. Classes 1 to 34 relate to
goods while 25 to 34 relate to services.
The new Nice
Classification (11th Edition Version 2018) will come into force on
January 1, 2018
It will appear
that this recent review is aimed to clarify the use of certain words in the
international classification as there appears to be only innocuous changes in
the heads of products and services under each class. However, certain words
were deleted while others were added. The review is more evident in the
explanatory notes as the committee strives to provide attorneys, trademark
owners and agents with a clearer understanding of the specific products and
services under each class.
